These Terms and Conditions apply to all of our services. These services are available directly or indirectly through distributors online, via any mobile device, by email, or by phone. By visiting, viewing, and using our website, mobile site, or any other application through a platform (hereinafter collectively referred to as the “Platform”), and/or by making a booking, you confirm that you have read, understood, and agreed to these Terms and Conditions, including the Privacy Policy and the Cookie Policy. Agreement by means of a checkbox is considered a legally valid electronic consent.

The content, structure, and pages of this website, as well as the online booking service (including the payment facilitation service), are owned, managed, and provided by Localistings.

Article 1. Definitions

Localistings: we, us, our, the sole proprietorship under Belgian law as stated in the company information.
Platform: the website, mobile site, and/or application where the booking service is available, owned, managed, and/or hosted by Localistings.
Listing: the various travel-related products and services that you can order, purchase, pay for, rent, book, combine, or personally use from the Host.
Host: the provider of an accommodation (for example, an apartment, B&B, campsite, vacation home) or other travel-related products and services (for example, activities, attractions, transportation, tour operators, travel insurance) that are available through the Platform and may operate B2C and/or B2B.
Booking Service: the online purchase, payment, or booking service offered or enabled by Localistings with respect to products and services provided by Hosts on the Platform.
Booking: the rental order, purchase, payment, or reservation.
User: any natural or legal person using the Platform, including both guest and host.
Commission: the fee owed by the Host to Localistings per confirmed Booking.

Article 2. Purpose and features of our services and role of Localistings

Through the Platform, Localistings and its affiliated distribution partners provide an online environment where Hosts, within their B2C and/or B2B business activities, can advertise, promote, sell, and/or make their products and services available for ordering, purchasing, booking, or renting for both short- and long-term stays.

Visitors can use the Booking Service to view, search, compare, order, book, purchase, or pay. By using the Booking Service, the Guest enters into a legally binding agreement with the respective Host.

Once a Booking is completed, Localistings acts solely as an intermediary between the Guest and the Host. We forward the booking details to the Host and send a confirmation email on their behalf. Localistings does not directly sell or rent products or services and is not a party to the rental agreement.

When facilitating the Booking Service, the information on the Platform is based on data provided by Hosts. Hosts have direct access to manage prices, fees, surcharges, availability, policies, and conditions, and they are solely responsible for their accuracy and completeness.

Although we strive for accuracy, we do not guarantee that all information is always correct, complete, or error-free. We are not liable for inaccuracies, misleading information, typographical errors, or interruptions (for example, due to maintenance or system failures). Obvious errors, including typographical mistakes, are not binding.

Our Platform may not be considered a recommendation, certification, or endorsement of the quality, service level, suitability, rating, accommodation type, benefits, facilities, vehicles, or other products or services of a Host, unless explicitly stated otherwise.

The Booking Service is available for personal, non-commercial use only. It is not permitted to resell, deep link, use, copy, monitor (for example, via scraping or spiders), display, download, or reproduce any content, information, software, reservations, tickets, products, or services of our Platform for commercial or competitive purposes.

Localistings reserves the right to moderate, refuse, block, or remove Listings and content in cases of suspected fraud, illegality, or violation of these Terms and Conditions.

Article 3. Registration, use, and verification

Users must register with accurate, complete, and up-to-date information and keep this information current.

Accounts are personal and non-transferable without the prior written consent of Localistings.

The following are prohibited: misleading or false Listings, circumventing the reservation system, manipulating reviews, uploading infringing or unlawful content, and committing fraud.

Localistings may request reasonable verification measures, including identity checks and verification of rental licenses or registration numbers where legally required.

Article 4. Prices, taxes, and currency calculator

The prices displayed on the Platform are provided by Hosts and are highly competitive.

All prices listed for Listings include VAT, sales tax, and other applicable taxes and fees, unless otherwise stated on the Platform or in the confirmation email or ticket.

Ticket prices may be displayed per person or per group and may remain valid until the expiration date stated on the ticket.

The currency calculator is for informational purposes only. Displayed exchange rates are not necessarily real-time or exact.

Some prices may be lower but come with special restrictions, such as non-refundable or non-cancellable conditions. Always check the applicable conditions carefully.

Obvious errors are not binding. No rights can be derived from offers or promotions that are not clearly marked as such.

Article 5. Commissions, payments, and fee structure for Hosts

Hosts pay a commission of 10 percent including VAT per confirmed Booking to Localistings after the end user has completed and paid for the Booking of the Host’s service or product.

Localistings may deduct the commission from the amounts paid by the Guest or invoice it periodically.

Unless otherwise agreed, Localistings will transfer the remaining amount to the Host within 7 business days after the Guest has paid in full and no holds, chargebacks, or fraud investigations are pending.

Hosts may improve their ranking by voluntarily paying a higher commission (“Promotion”). The ranking algorithm takes commission increases into account when determining the default ranking. Program partners pay a higher commission in exchange for a higher ranking.

If the Host cancels a confirmed Booking, the commission of 10 percent on the total booking amount remains fully due and is non-refundable, regardless of the reason for cancellation.

Localistings may change prices, commissions, or fee structures. In the case of significant changes, Hosts will be informed at least 30 days in advance.

Article 6. Payment methods, payment facilitation, and responsibility

Hosts may offer direct online payments through secure payment solutions provided by third-party processors. Localistings facilitates the payment on behalf of the Host but is not a financial intermediary or a party to the financial transaction between Guest and Host.

Any payment made on behalf of the Guest and transferred to the Host constitutes a final settlement of that portion of the booking price. Amounts already paid cannot be claimed back from Localistings.

For specific non-refundable rates or offers, prepayment by transfer or card may be required. The card may be authorized or charged at the time of booking. Always check the booking details for confirmation.

Localistings is not responsible for authorized or allegedly unauthorized charges made by the Host. Any disputes regarding such charges must be resolved directly with the Host.

In case of fraud or unauthorized card use, many banks and card issuers cover this with a deductible.

Article 7. Cancellation, no-show, and standard cancellation policies

By booking with a Host, the Guest agrees to the Host’s cancellation and no-show policy, as well as any additional conditions.

Hosts can choose from three standard cancellation policies. The selected option applies per Booking and will be displayed in advance.

Flexible: free cancellation up to 7 days before check-in. Cancellation between 7 days and 24 hours before check-in: 50 percent refund. Within 24 hours: no refund.

Moderate: free cancellation within 48 hours after booking provided check-in is at least 30 days away. Between 30 and 14 days before check-in: 50 percent refund. Less than 14 days: no refund.

Strict: free cancellation within 48 hours after booking provided check-in is at least 30 days away. After that period: no refund.

In addition to this policy, Hosts may apply their own conditions regarding use, access, liability, and deposits. These must be clearly stated in the Listing, for example under “More information.”

Certain prices, fees, or offers may be non-refundable and non-changeable. Municipal or tourist taxes may remain due even in cases of no-show or cancellation.

Where a deposit is required, failure to pay on time may result in automatic cancellation.

Late payments, incorrect account or card details, invalid cards, or insufficient funds may result in the loss of prepaid amounts without refund, unless the Host decides otherwise.

Guests can manage their Booking through the confirmation email or by contacting the Host directly.

If you expect to arrive late or after the scheduled check-in date, you must contact the Host in time to avoid cancellation or no-show fees. Localistings only facilitates communication and is not responsible for consequences of late arrivals or any associated costs.

Article 8. Correspondence and communication

After making a Booking, you may receive:

  • An email prior to arrival with destination tips and relevant offers, including promotions from third parties if you have opted in.

  • An email after arrival with a request for feedback about the Host and the rental service.

  • A follow-up email with an invitation to leave a review.

Localistings is not responsible for communication between you and the Host through the Platform and does not guarantee that messages will be received, read on time, or answered.

To complete your Booking, you must provide a valid email address. Localistings is not responsible for errors caused by misspelled addresses, incorrect phone numbers, or invalid card details.

Claims or complaints against Localistings regarding the rental service must be submitted no later than 10 days after the scheduled service date (for example, the check-out date). Late claims may be rejected. Consumers in the EEA may contact our customer service.

Article 9. Ranking, program recommendations, star ratings, and guest reviews

We display a personalized default ranking. You may use filters and alternative sorting options. Our algorithms evolve continuously.

Star ratings are not determined by us and may come from the accommodations themselves or from independent parties such as Google or Tripadvisor. We do not establish formal rating requirements and do not verify them.

Only Guests who have stayed at a property will receive an invitation to leave a review. Reviews may be published on the Host’s page and may be used by Localistings for marketing and service improvement.

Localistings does not allow Hosts to respond to reviews. We may edit, reject, or remove reviews that violate our policy. There is no incentive or compensation provided for leaving feedback.

The following are prohibited in reviews:

  • Profanity, sexual content, hate speech, violence, discrimination, threats

  • Full names, personal attacks on staff

  • Promotion of illegal activities

  • Mention of websites, emails, phone numbers, addresses, or card details

  • Politically sensitive remarks

Article 10. Community and user contributions

Localistings provides a community where registered users can share contributions. Minimum age is 18 years.

Users are fully responsible for their own contributions. Content may not be unlawful, misleading, harmful, or infringing, and may not be used as spam.

Notice and action under the Digital Services Act: we provide a reporting system, remove or block content when made aware of illegal or conflicting material, and apply reasonable, objective, and proportionate moderation.

Hosting exemption: Localistings is not liable for hosted content as long as it had no knowledge of unlawful material and acts promptly upon notification.

Users shall fully indemnify Localistings against any third-party claims arising from their contributions.

Localistings publishes an annual summary report on removed content and complaints in compliance with the DSA.

Article 11. Intellectual property and licenses

Unless otherwise stated, the software, content, and database rights of the Platform belong to Localistings and/or its licensors or Hosts.

Reuse, scraping, data mining, or framing is not permitted without prior written consent.

By uploading photos or images (for example, in reviews), you confirm that you hold the rights to them and you grant Localistings a non-exclusive, worldwide, irrevocable, royalty-free, and unlimited license to host, reproduce, display, distribute, sublicense, and communicate such images. You bear full responsibility and shall indemnify Localistings against any third-party claims. Localistings may remove images that do not comply.

Article 12. Liability and disclaimer

To the extent permitted by law, our liability is limited to direct damages caused by a breach of our obligations and capped at the total amount of your Booking as specified in the confirmation, whether arising from a single event or a series of related events.

To the extent permitted by law, we and our affiliated parties are not liable for:

  • Special, indirect, or consequential damages, including loss of production, profit, revenue, contracts, goodwill, or reputation

  • Inaccuracies or misrepresentations in information provided by Hosts

  • Services or products of Hosts or other partners

  • Damages resulting from the use of or inability to use the Platform

  • Injury, death, property damage, or other harm resulting from acts or omissions of Hosts or partners, including cancellations, overbookings, strikes, or force majeure events

The Host is solely responsible for collecting, withholding, reporting, and remitting applicable taxes on the total rental price. Localistings is not responsible for this.

Article 13. Force majeure, maintenance, and availability

Localistings is not obliged to perform its obligations in cases of force majeure, including third-party failures, network or infrastructure issues, natural disasters, pandemics, wars, strikes, or government measures.

We may maintain and modify the Platform. We strive for reasonable availability but do not guarantee uninterrupted or error-free operation.

Article 14. Electronic consent, evidence, and version control

Consent given through a checkbox or other electronic confirmation is legally valid.

Localistings records the date and time of acceptance and archives the version that was in effect at that moment.

In the event of discrepancies between versions, the version in effect at the time of acceptance by the User shall prevail.

Article 15. Termination of cooperation and suspension

Both Localistings and the Host may terminate the cooperation subject to the agreed notice period.

Localistings may immediately suspend or terminate accounts in cases of fraud, breach of contract, serious default, bankruptcy, or violation of law or these Terms and Conditions.

Provisions that by their nature are intended to remain in effect shall survive termination.

Article 16. Complaints procedure

Complaints may be submitted via the contact page. We will respond within a reasonable timeframe.

Claims against Localistings regarding the rental service must be submitted no later than 10 days after the scheduled service date (for example, the check-out date). Late claims may be rejected.

Article 17. Language, translations, and precedence

The original Dutch version may be translated into other languages. These translations are for informational purposes only.

In the event of discrepancies or conflicts between the Dutch version and a translated version, the Dutch version shall prevail, apply, and be considered final to the extent permitted by law.

The Dutch version is available through the Platform or upon written request.

Article 18. Applicable law, jurisdiction, and consumer protection

These Terms and our services are governed by Belgian law.

All disputes shall be submitted exclusively to the competent courts in Belgium.

Notwithstanding the foregoing, consumers who use our services for purposes outside their trade or profession may rely on the mandatory legal provisions of their country of residence. Legal actions directly related to the consumer may also be brought before the courts of the consumer’s country of residence.

Article 19. Amendments

Localistings may amend these Terms and Conditions. Amended Terms will be published electronically and are binding from the announced effective date.

In the case of significant changes, Localistings will inform Hosts and Guests at least 30 days in advance. Continued use after the effective date constitutes acceptance.

Article 20. Final provisions

If any provision is invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a provision that most closely reflects the original intent.

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between Localistings and Users regarding the subject matter hereof.

Without prior written consent from Localistings, the User may not transfer their rights or obligations.

Acceptance
By creating an account, posting a Listing, or booking an accommodation, the User confirms that they have read, understood, and accepted these Terms and Conditions.
